Rule Proposal Available for Public Comment

The State Agriculture Development Committee (Committee) is proposing new rules and amendments pursuant to the Right to Farm Act (RTF Act), N.J.S.A. 4:1C-1 et seq., and the New Jersey Agriculture Retention and Development Act, N.J.S.A. 4:1C-11 et seq.

The proposed new rules, N.J.A.C. 2:76-2A.10, 2B.3 and 6.24, will expand the list of protected activities under the RTF Act to: include equine service activities; set forth agricultural management practices with which farmers would need to comply to be eligible for protections of the Act; and clarify which equine activities are permitted on preserved farms and under what conditions.

The proposed amendment to N.J.A.C. 2:76-2A.8 changes the agricultural management practice regarding "on-farm compost operations" previously adopted by the Committee to make it consistent with the proposed new rules.

Interested persons may submit comments, information or arguments concerning any of the rule proposals in this issue until September 14, 2007. Submissions and any inquiries about submissions should be addressed to:

                 Susan E. Craft, Executive Director
